Terms of Service
These Terms of Service govern access to MirrorCaption, including use of the app, paid plans, acceptable use, refunds, account suspension or termination, liability, and dispute resolution.

1. About the service
MirrorCaption is a web app that offers live transcription, translation, summaries, and related account-linked features.
We may modify, suspend, replace, or discontinue any part of the service — including features, integrations, free-tier benefits, or third-party dependencies — at any time, with or without notice. We will use reasonable efforts to communicate material changes that affect paid customers in advance.
Some parts of the service depend on third-party infrastructure and may change, become unavailable, or be replaced over time without separate notice.
2. Accounts and eligibility
You are responsible for maintaining the confidentiality of your login credentials and for activity that occurs under your account.
You may use the service only in compliance with applicable law and these Terms.
You must be at least 16 years old, or the minimum age of digital consent in your jurisdiction, to create an account.
3. Plans, billing, and credits
MirrorCaption may offer paid plans, subscriptions, one-time purchases, or usage-based credits. Prices, included benefits, and any applicable limits will be shown at checkout or in the product.
- Payments are processed by third-party payment providers. By purchasing, you agree to their respective terms.
- Usage-based features consume credits or quota according to the billing rules shown in the app. Quotas are non-transferable between accounts.
- For subscriptions, your current billing period continues at the price you originally agreed to. We may change pricing for future renewals; if the renewal price changes, we will notify you at least 30 days before the renewal date so that you may cancel before the new price takes effect.
- For one-time purchases (such as voice packs or the lifetime plan), the purchase price applies only to that specific purchase and confers no right to future price stability for additional purchases.
- All prices are stated in Euro and include applicable VAT where shown. Currency conversion is handled by the payment provider and may include conversion fees.
4. Refunds and right of withdrawal
Where you purchase digital content or services as a consumer in the European Union, you have a statutory 14-day right of withdrawal under Directive 2011/83/EU. By starting to use a paid feature (such as consuming any portion of included quota), you expressly request immediate performance and acknowledge that your right of withdrawal lapses once performance has begun, in accordance with §356(5) BGB.
Subject to your statutory rights, the following apply:
- Subscription fees are non-refundable for the current billing period once the period has begun, except where required by law.
- Consumed quota, credits, or voice-pack hours are non-refundable.
- Unconsumed quota does not roll over to a new billing period unless the plan rules state otherwise.
- We may, at our discretion, review refund requests for duplicate charges, technical billing errors, or clear service-delivery failures on a case-by-case basis.
5. Acceptable use
You may not use MirrorCaption in a way that is unlawful, abusive, fraudulent, or harmful to the service or to others.
- Do not interfere with or attempt to disrupt the service, its infrastructure, or its security controls.
- Do not misuse billing, quotas, account systems, refunds, promotional credits, or access controls.
- Do not share, resell, or redistribute access to your account or to your purchased entitlements.
- Do not use automated tools to access the service in a way not expressly permitted by us.
- Do not use the service for unlawful surveillance, fraud, harassment, or other prohibited activity.
- Do not rely on generated output as the sole basis for legal, medical, financial, safety-critical, or similarly high-risk decisions.
- Do not record any conversation using the optional local recording feature without first obtaining all consents and notices required by the laws applicable to that conversation.
- Any other behavior that, in our reasonable judgment, materially harms the service, its operators, or other users.
6. Suspension and termination
We may suspend or terminate access — immediately and without prior notice where appropriate — if you violate these Terms, abuse the service, fail to pay applicable fees, or where suspension is required for legal, security, or operational reasons.
In the case of suspension or termination for cause, we are not obliged to refund any unconsumed quota, credits, or paid-period balance, except where required by mandatory law.
You may stop using the service at any time. If you want your account removed, you can use the in-app account deletion flow.
7. Disclaimers and limitation of liability
MirrorCaption is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we make no warranties or representations, express or implied, regarding accuracy, fitness for a particular purpose, uninterrupted availability, or freedom from errors. Transcription, translation, and AI-assisted output may be incomplete, delayed, or inaccurate.
To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with the service or these Terms — whether in contract, tort (including negligence), or otherwise — is limited, per claim and in the aggregate, to the lower of (a) the total amount you actually paid to us in the twelve (12) months preceding the event giving rise to the claim, and (b) one hundred Euro (€100).
The limitation does not apply to: (i) damages arising from injury to life, body, or health; (ii) liability under the German Product Liability Act (Produkthaftungsgesetz); (iii) liability for intent or gross negligence; or (iv) any other liability that cannot be limited or excluded under mandatory applicable law. For slight negligence, we are liable only for breach of essential contractual obligations (Kardinalpflichten), and only up to typical, foreseeable damages.
We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or loss of goodwill, except where such liability is mandatory under applicable law.
You acknowledge and agree that any local recording you create using the optional audio recording feature is created and stored entirely on your device under your sole control and responsibility. You are responsible for compliance with all applicable laws regarding recording, including consent and notice requirements in your jurisdiction. To the maximum extent permitted by law, MirrorCaption disclaims liability for any claim, loss, or damage arising out of your use of the recording feature, and you agree to indemnify MirrorCaption against any third-party claim arising from recordings you have created.
8. Your content and license to us
You retain all ownership rights in the audio, transcripts, summaries, and other content you process through MirrorCaption ("Your Content").
You grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, process, transmit, transcribe, translate, summarize, store, and otherwise use Your Content solely to operate, secure, support, and improve the service for you. This license terminates when Your Content is deleted from our systems, except for backups, audit logs, or aggregated/anonymized data retained as permitted under our Privacy Policy or applicable law.
You represent and warrant that you have all rights and consents necessary to submit Your Content to the service and to grant the license above. We do not actively monitor Your Content but may remove or refuse to process content that, in our reasonable judgment, violates these Terms or applicable law.
9. Feedback
If you choose to provide ideas, suggestions, bug reports, or other feedback about the service ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to use, modify, and exploit such Feedback for any purpose, without obligation or compensation to you. You waive any moral rights in such Feedback to the extent permitted by law.
10. Force majeure
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to outages or material changes by third-party infrastructure providers (including but not limited to speech-to-text providers, AI model providers, payment processors, hosting and CDN providers), internet outages, network attacks, governmental action, war, civil unrest, labor disputes, pandemics, or natural disasters. Where such an event materially impairs the service, our obligations are suspended for its duration.
11. Updates to these Terms
We may update these Terms from time to time. For non-material changes (such as clarifications, formatting, or contact information), the revised Terms become effective when published.
For material changes that adversely affect your rights or obligations, we will provide at least 30 days’ advance notice by email to the address associated with your account or through a prominent in-product notice. If you do not agree to the changes, you may terminate your account before the changes take effect; continued use of the service after the effective date constitutes acceptance only where mandatory applicable law permits acceptance through continued use.
12. Governing law and jurisdiction
These Terms and any dispute arising out of or in connection with them or the service are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG) and excluding the conflict-of-laws rules of German private international law.
For business customers (Kaufleute within the meaning of the German Commercial Code, legal entities under public law, or special funds under public law), the exclusive place of jurisdiction for all disputes is Düsseldorf, Germany.
For consumers, the choice of law in the preceding paragraph does not deprive you of the protection afforded to you by mandatory provisions of the law of the country in which you have your habitual residence (Article 6(2) Regulation (EC) No 593/2008 — Rome I). Consumers may bring proceedings against us, and we may bring proceedings against consumers, only in the courts that have jurisdiction under mandatory rules of consumer protection law (Articles 17–19 Regulation (EU) No 1215/2012 — Brussels Ia).
The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
13. Miscellaneous
These Terms, together with the Privacy Policy and any plan-specific terms shown at purchase, constitute the entire agreement between you and us regarding the service and supersede any prior agreements on the same subject matter.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions remain in full force and effect. The invalid provision will be replaced by a valid provision that most closely reflects the original economic intent, to the extent permitted by applicable law.
We may assign or transfer these Terms, in whole or in part, including in connection with a merger, acquisition, reorganization, or sale of assets. You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
